Privacy notice (KVKK)

This notice is provided by Balsera İnşaat ve Yapı Malzemeleri San. Tic. A.Ş. ("Balsera") as data controller under Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK") and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform, to inform you about the personal data processed through the balsera.com.tr website (the "Site").

Personal data we process

  • Identity and contact details: name, email address, phone number.
  • Company and professional details: company name, country, profession or role (in professional membership applications, project and wholesale requests and export requests).
  • Request content: messages you send via the contact, project and wholesale, export, customer service and career forms; order number; preferred date for a showroom visit; products you are interested in; the position you apply for.
  • Professional portal membership data: account details, an irreversible hash of your password (the password itself is not stored), email verification record, your favourites and records of product images and documents you download.
  • Newsletter data: your email address and language preference.
  • Security data: IP address, browser information, form submission and server logs.
  • Technical error and performance records: errors occurring on our pages and page load times. These records do not include IP addresses, cookies, form contents or contact details.

We do not ask for special categories of personal data (e.g. health, religion, biometric data) through the Site; please do not include such information in the forms.

Purposes

  • Receiving, evaluating and responding to your requests, questions, quote requests and applications; scheduling showroom visits.
  • Conducting business discussions and preparing quotes for project, wholesale and export requests.
  • Creating, verifying and managing professional portal accounts; providing access to product images and technical documents.
  • Evaluating job applications.
  • Sending our newsletter where you have consented.
  • Keeping the Site secure, preventing misuse and spam, detecting and fixing technical errors.
  • Making encrypted backups to prevent data loss.
  • Complying with our legal obligations and requests from competent authorities.

Collection method and legal basis

Your data is collected electronically, partly by automated means, through forms, membership and sign-in processes and server logs on the Site, and processed on the following legal grounds:

  • Necessity for the conclusion or performance of a contract (KVKK Art. 5/2-c): request and quote processes, professional membership, job applications.
  • Compliance with our legal obligations (Art. 5/2-ç).
  • Establishment, exercise or protection of a right (Art. 5/2-e).
  • Our legitimate interest, provided it does not harm your fundamental rights and freedoms (Art. 5/2-f): Site security, error and performance monitoring, encrypted backups.
  • Your explicit consent (Art. 5/1): newsletter; loading the showroom map from Google with your permission.

Transfers

Your data is shared, limited to the purposes above and only as necessary, with:

  • Our hosting provider (Hostinger): the Site and database are hosted on servers in Germany (Frankfurt).
  • Our email delivery provider (Resend, USA): delivering form notifications and membership and verification emails.
  • Our error monitoring provider (Functional Software, Inc. — Sentry; data stored in Germany): technical error and performance records. Records are sent via our own server; IP addresses, cookies, form contents and contact details are removed before sending.
  • Our encrypted backup provider (Google — Google Workspace): backups of the database and uploaded files are stored encrypted with a key held only by Balsera; the provider cannot access their contents.
  • Map service (Google): the map on the showroom page is loaded from Google's servers when you allow the map in your cookie preferences or click "Show map"; Google then processes your IP address and browser details.
  • Competent public authorities: where required under our legal obligations.

As the servers of our hosting, email, error monitoring and backup providers are located abroad, your personal data is transferred abroad. Such transfers are carried out in accordance with Article 9 of the KVKK. We do not sell your personal data or share it with third parties for marketing.

Retention

  • Form requests (contact, project and wholesale, export, customer service, career): 2 years from the date of the request, after which they are deleted automatically. If your request leads to a contract, the related records are kept in our business records for the statutory retention periods.
  • Professional portal account and the related favourites and download records: for as long as your account remains open; deleted when you ask us to close your account.
  • Newsletter: deleted when you ask to unsubscribe.
  • Technical error and performance records: up to 30 days.
  • Encrypted backups: daily backups are kept for 35 days and monthly backups for 400 days. A deleted record may remain in backups until these periods expire; the backups are then deleted as well.

Your rights

Under Article 11 of the KVKK you may apply to the data controller to exercise the following rights:

  • To learn whether your personal data is processed.
  • To request information if it has been processed.
  • To learn the purpose of processing and whether it is used for that purpose.
  • To know the third parties in Turkey or abroad to whom it is transferred.
  • To request correction if it is incomplete or inaccurate.
  • To request erasure or destruction under the conditions of Article 7 of the KVKK.
  • To request that the third parties to whom your data was transferred be notified of such correction, erasure or destruction.
  • To object to a result against you arising from analysis exclusively by automated systems.
  • To claim compensation if you suffer damage from unlawful processing.

You may withdraw your consent for processing based on explicit consent at any time (map: "Cookie preferences" at the bottom of the page).

How to apply

You can submit your request in Turkish, with information identifying you, in line with the Communiqué on the Procedures and Principles of Application to the Data Controller, by one of the following means:

  • Signed with a secure electronic or mobile signature, or from the email address you have previously provided to us and which is registered in our systems: info@balsera.com.tr

Your request will be concluded free of charge as soon as possible and within 30 days at the latest; if the process involves an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.
